This question is before us upon the following certificate from the Fifth District:

"Appellant, W. R. Byrd, brought an injunction suit against appellees, the City of Dallas and the Board of Trustees of the Firemen, Policemen and Fire Alarm Operator’s Pension Fund to enjoin them from paying out pensions to Louis W. Brown, Sam Duncan, Theo Harrison, John W. Ryan and J. H. Tanner, retired policemen, and T. A.
