Appeal from a judgment of the County Court of Rensselaer County (Jacon, J.), rendered January 18, 2011, *1372convicting defendant upon his plea of guilty of the crime of rape in the first degree.

Defendant waived indictment and pleaded guilty to a superior court information charging him with rape in the first degree. The charges stemmed from an incident that occurred on New Year’s Eve in 2008, when defendant engaged in sexual intercourse by forcible compulsion with a 14-year-old victim.
