WILBUR, Circuit Judge.
This appeal is from the order of the District Court of the United States denying a petition for a writ of habeas corpus and remanding appellant to the custody of appellee for deportation.
Appellant, an alien Chinese person, was admitted to the United States on March 24, 1917, as a minor son of a Chinese *837merchant. On November 23, 1921, appellant was convicted in the superior court of the state of California in and for Yuba county, of the crime of murder and sentenced by that court to imprisonment for a term of from seven years to life.
