RIDGE, District Judge.

Petitioner presents application for leave to file in forma pauperis petition for writ of habeas corpus. The petition attached to said application elicits the following facts.

Petitioner is now confined in the Missouri State Penitentiary, in the custody of respondent as Warden. On June 20, 1932, petitioner was sentenced to said penitentiary for a term of 10 years, for the crime of robbery, first degree.
