First. When C. M. King, a member of the panel, was being examined as to his qualifications as a juror, he was asked as to whether or not he entertained such conscientious scruples against the infliction of death as a penalty for crime as would prevent him from rendering a verdict for murder and assessing the death penalty in ease he was taken on the jury, to which he answered that he did entertain such conscientious scruples, but he further answered’ that, whenever the law gave him the right to inflict the death penalty or imprisonment for life, he did not have such…
