Wilson, District Judge.

Plaintiff in error, hereinafter called the defendant, was convicted for contempt, and prosecutes error to this court. We reverse the judgment of the trial court.

*945The action out of which the contempt proceeding arises was commenced in the district court for Buffalo County by Virginia Lippineott, as plaintiff, and subsequently prosecuted by defendant in error, hereinafter called the plaintiff, as substituted plaintiff, against defendant in this action and others as defendants.
