MEMORANDUM OPINION AND ORDER GRANTING IN PART AND DENYING IN PART PLAINTIFF’S SEALED MOTION FOR PARTIAL SUMMARY JUDGMENT AND TO STRIKE DEFENDANTS’ AFFIRMATIVE DEFENSES

THIS MATTER comes before the Court upon Plaintiffs Sealed1 Motion for Partial Summary Judgment and to Strike the Defendants’ Affirmative Defenses, filed September 20, 2013 (Doc. No. 150). Having considered the parties’ arguments and the applicable law, the Court finds that Plaintiffs motion is partially well-taken and, therefore, is GRANTED in part and DENIED in part.
