The questions presented in this appeal are whether a Maryland statute relating to incorporation of an unincorporated area violates the fourteenth amendment to the United States Constitution and, if so, whether the challenged portion of the statute should be severed, with the rest of the statute left intact.1 Plaintiffs-appellants seek a declaratory judgment holding the offending section of the Maryland statute unconstitutional.
