MEMORANDUM DECISION DENYING LAWRENCE’S DISCHARGEABILITY CLAIM

The primary issue before the court is whether an unscheduled creditor, having actual knowledge of the Debtor’s bankruptcy case, is barred from asserting a non-dischargeability claim because of its failure to file a complaint within the deadline period set for dischargeability claims. The court concludes that the objection to dis-chargeability is barred as late filed pursuant to 11 U.S.C. § 523(c)(1) and Bankruptcy Rule 4007(c).
