DECISION DENYING DEFENDANT’S MOTION TO DISMISS. DISCHARGE-ABILITY COMPLAINT

This is a suit against an investment adviser for fraudulently inducing the plaintiffs to invest in risky options and seeking to hold the claims nondischargeable under 11 U.S.C. §§ 523(a)(2)(A) and 523(a)(4). The defendant seeks to dismiss the plaintiffs’ amended complaint for failure to state a claim upon which relief can be granted.
