Michael C. Thrasher, a former Sergeant with the Clayton County Police Department (CCPD), appeals the district court’s denial of his motion for summary judgment in a civil rights lawsuit filed against him by Herbert W. Perkins.

In an 8-count complaint, ' Perkins brought claims for false arrest, malicious prosecution and excessive force pursuant to 42 U.S.C. § 19⅜3, as well as five Georgia state law claims for malicious arrest, malicious prosecution, false imprisonment, punitive damages and attorney’s fees.
