hThe defendant, Frederick Preston, Jr., was charged by bill of information with sexual battery, a violation of LSA-R.S. 14:43.1. Following a jury trial, he was found guilty of the responsive verdict of attempted sexual battery. He was adjudicated a third-felony habitual offender and was sentenced to serve seven years in prison at hard labor, without benefit of probation, parole or suspension of sentence. For the reasons that follow, we affirm the defendant’s conviction, adjudication and sentence. However, we remand this matter to the trial court with instructions to provide the appropriate…
