In Equity. Suit by William Forse Scott, official or general assignee in bankruptcy for the Southern district of New York under the Bankruptcy Act of August 19, 1841, as assignee in bankruptcy of Tilly Allen, bankrupt, against the George’s Creek Coal & Iron Company.

ROSE, District Judge.

Under the Bankruptcy Act of 1841 (Act Aug. 19, 1841, c. 9, S Stat. 440) the complainant is the general assignee in bankruptcy for the Southern district of New York. He sues as assignee in bankruptcy of one Tilly Allen. The defendant is the George’s Creek Coal & Iron Company, a Maryland corporation. The bill was filed September 9, 1912. It alleges that on March 22, 1841, certificates for 58 shares of the stock of. the defendant corporation were issued to Tilly Allen in trust.
