Leroy Walker and his wife sued MARTA, a common carrier, to recover damages for injuries and loss of consortium caused by a criminal attack on Leroy Walker at the Georgia State MARTA station in Atlanta. The Walkers appeal summary judgment for MARTA. The primary issue is whether the absence of evidence in the record of prior violent activity on a common carrier entitles the common carrier to summary judgment. It does.
