— Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiff’s decedent, an employee of third-party defendant William Kugler & Bros., Inc. (Kugler), was killed when a steel beam being hoisted by a crane from a pile of debris slipped, striking *1031decedent in the head.
