OPINION

CORNISH, Judge:

Appellant, Johnny Wilborn Brown, hereafter referred to as defendant, was convicted in a nonjury trial in the Pontotoc District Court, Case No. CRM-77-190, for Driving Under the Influence of Intoxicating Liquor, contrary to 47 O.S.1971, § 11-902. Punishment was assessed at ten (10) days in jail and a Three Hundred Dollar ($800.00) fine.
