The plaintiffs, Styrene Information and Research Center, Inc. (the “Styrene Center”) and Dart Container Corporation, bring this action under the Administrative Procedure Act (“APA”), 5 U.S.C. § 704 (2006), challenging the decision of the United States Department of Health and Human Services (“HHS”) to list the substance styrene in its Twelfth Report on Carcinogens.
