In August, 1968, Jonathan Jeffries was injured as he attempted to jump on a dump truck driven by Wayne Stewart, an uninsured motorist. Jeffries incurred medical expenses in excess of $1500 as a result of this accident. In his action against Stewart, Jeffries joined his insurer, Motor Vehicle Casualty Company (insurer), when the insurer refused to pay Jeffries the amount he thought was owed him under the uninsured motorist and the medical payments provisions of his policy with insurer.
