Millie Cook, by Will Cook as next friend, brought a suit in Miller County against L. Cook, a resident of that county, and J. XJ. Grimsley, a resident of Decatur County. The petition also named the plaintiff herself as a party defendant therein, she being a resident of Miller County. The defendant Grimsley demurred to the petition upon the following among other grounds: (1) The petition is demurred to generally and as a whole, because the same sets forth no legal or equitable cause of action.
