— Appeal by the People, as limited by their brief, from so much of an order of the County Court, Suffolk County (Tisch, J.), dated April 11, 1988, as granted that branch of the defendant’s motion which was to dismiss the second count of the indictment charging him with assault by operating a vessel in the second degree, on the ground that prosecution for that charge was barred by CPL 40.20 (2). By decision and order dated June 12, 1989, this court reversed the order insofar as appealed from, on the law, and reinstated the second count of the indictment (see, People v Claud, 151 AD2d 594).
