An indictment, dated November 28, 1934, returned by the grand jury of Multnomah county against one Art Shearer and 33 others charged the indictees with the crime of rioting. The four appellants are not in the group just mentioned. The indictment alleges that the 34 defendants on August 20, 1934, tumultuously assembled, armed themselves with missiles and clubs and then hurled these objects in the direction of an individual named James Conner.
