|! Appellant Charles Wayne “Chad” Green was convicted of four counts of capital murder and one count of kidnapping. He received life sentences for each count of capital murder and a forty-year sentence for the count of kidnapping. On appeal, he contends that the State’s use of inconsistent prosecutorial theories in his trial and in the separate trial of a co-defendant denied him due process of law, or alternatively, that the State was judicially estopped from arguing inconsistent theories.
