Plaintiff appeals from the judgment of no cause of action entered March 29, 1985, by Monroe Circuit Court Judge James J. Kelley.
This case involves a wrongful death action in which plaintiff, Floyd Sells, sought to recover as administrator for the estate for the wrongful death of his son, Joel Sells. Joel Sells was killed when the automobile he was driving was struck by a police car driven by defendant Edward Burns, a Monroe County deputy sheriff, on Monroe Street near the Denniston Drive-In Theatre.
