Appeal from a judgment of the superior court for Pierce county, Clifford, J., entered July 3, 1915, upon findings in favor of the plaintiff, in an action of replevin, tried to the court.

Main, J.-

The purpose of this action was to recover possession of a piano. After the issues were joined, the cause was tried to the court without a jury, and resulted in a judgment in favor of the plaintiff. From this judgment, the defendants have appealed.

*684The facts are these: On September 29, 1911, Eiler’s Music House, the respondent, by a conditional sale contract, sold to J. H. Douglass a Kimball piano for $359.
