Plaintiff Robert D. Melvin (“Plaintiff’) filed, as the personal representative of the Estate of Robert D. Melvin II, deceased, a complaint in Indiana state court on April 2, 1996 against Defendants Mark K. Patterson and Whitehead Specialties, Inc. (“Defendants”). Included in the complaint were claims under the Indiana Wrongful Death Act, Ind.Code § 34-1-1-2, that Plaintiff made on behalf of the decedent’s two alleged children.
