Judy Kratville appeals the district court’s dismissal of her employment discrimination suit on the ground of claim preclusion. The district court previously had granted summary judgment against her on a nearly identical claim because she had failed to exhaust her administrative remedies in a timely manner. Ms. Kratville argues that: (1) her present cause of action is not the same because, by filing a complaint with the EEOC, she has cured the defect that caused the original dismissal; and (2) the district court erred in concluding that it was too late for her to effect…
