The Defendant has appealed from a chancery decree declaring he is estopped from asserting any rights as a surviving spouse in the estate of his deceased wife, including the right to a distributive share of her estate, a year’s support, exempt property or homestead.

The Defendant-Appellant, Wayne R. Jef-fers, and Margaret Jeffers, now deceased, were married in 1972. They were each about 40 years of age at the time of their marriage and each had a considerable amount of property. The properties of the Defendant consisted primarily of properties…
