OPINION
GODDARD, Judge.
This is an appeal as of right by Wayne R. Jeffers from a judgment entered July 31, 1989, in the Probate Court of Washington County, sitting without a jury, on his application for a year’s support1 out of the *136estate of his deceased wife, Margaret Jef-fers.2
Mr. Jeffers appeals contending the allowance was insufficient. Although the Executrix insisted at trial that Mr. Jeffers was not entitled to a year’s support, she did not pursue this contention on appeal.
