This is an action of contract upon a policy of fire insurance, issued by the defendant to the plaintiff on a dwelling house in Revere, in this Commonwealth. There was a verdict for the plaintiff in the sum of $7,114.50. The case is before this court solely upon the defendant’s exception to the denial of its motion for a directed verdict.

The policy is in the Massachusetts standard form and contains the following provisions: “In case of any loss or damage, the company, within sixty days after the insured shall have submitted a statement .... shall either pay the amount for which it shall be…
