MEMORANDUM OPINION

On the 14th day of April, 1965, the motion of the plaintiff for summary judgment came on for hearing. The *119arguments of counsel were made and the Court took the matter under advisement. The Court has carefully reviewed the contentions of the parties and concludes since there is no material issue of fact that summary judgment should be entered in favor of the plaintiff against the defendant as a matter of law. Rule 56 of the Federal Rules of Civil Procedure.
