In this appeal from the Superior Court, we address for the first time the application of the Motor Vehicle Franchising Practices Act (the “Act”), 6 Del.C. Ch. 49, in a dispute between an automobile manufacturer and existing dealerships. The Delaware Public Service Commission (the “Commission”), which is charged with administrative responsibility for enforcement of the Act, rejected the protests of the appellants, Future Ford Sales, Inc. d/b/a Sheehy Ford (“Future Ford”) and Bayshore Ford Truck Sales, Inc.
