This is an appeal from a decree of the circuit court for the southern district of New York in favor of the complainant in a bill in equity for the infringement of letters patent. On November 3, .1885, letters patent of the United States, No. 329,632, were issued to Carl Duisberg, a Herman, for an improvement in coloring matter known as “Benzo-Furpurine.” On December 21, 1885, Duisberg assigned the patent to a Herman corporation called “Farbenfabriken, vermals Fr. Bayer & Co.,” and known in the case as the “Bayer Company,” which was also the owner of a German patent for…
