This matter is before the Court on defendant’s motion to dismiss and plaintiffs cross motion for summary judgment.

BACKGROUND

SunRise Healthcare Corporation, d/b/a SunRise Care and Rehabilitation for University (SunRise) operates a 122 bed nursing facility in Edwardsville, Illinois. SunRise Healthcare Corporation operates approximately 420 nursing home facilities across the country.
