Plaintiff was injured when a Ford automobile, in which he and the driver were occupants, was struck by defendant company’s trolley car at the intersection of 52d Street and Girard Avenue in the city of Philadelphia, during daylight. The automobile was owned and driven at the time of the accident by George Perry, both men being on their way to Jenkintown, where they were employed by a building contractor as carpenters. Plaintiff sued to recover for the injuries received and the verdict was in his favor for $9,750. On motion for a new trial, the court ordered a…
