HIGGINS, Justice.
The principal question presented here is whether or not Act 14 of 1940, the State statute, which changed retrospectively the mode or method of inflicting the death penalty in capital cases from death by “hanging” to death by “electrocution”, violates the provisions of the State and Federal Constitutions prohibiting the legislative branch of the government from enacting ex post facto laws.
