Woodward, J.:

The accident on August 8, 1917, resulting in the death of John Pifumer on the same day occurred at Syracuse, while the decedent was employed by Rheinstein & Haas, Inc., of New York, in the construction of a building. There *822is no question about the accidental character of the death, or of any of the conditions of liability. The decedent had no wife or children, and the State Industrial Commission, under the provisions of section 17 of the Workmen’s Compensation Law (Consol.
