delivered tbe opinion of tbe Court:
We are compelled to sustain tbe motion to dismiss tbe writ of error granted in tbis case.
Tbe record sufficiently shows that during tbe trial, which terminated on March 13, 1902, tbe defendant excepted to certain rulings of tbe judge of tbe police court and gave notice of bis intention to apply to tbis court for a writ of error, in substantial compliance with tbe rule made by tbis court under tbe authority of tbe act of Congress conferring tbe appellate jurisdiction.
