Final judgment in this case was rendered on April 21,1886,. in the St. Clair circuit court, and appellant prayed and was allowed an appeal, the bond and bill of exceptions “to be filed” within sixty days. The bill of exceptions appearing in the record was not presented to the trial judge, nor signed and sealed by him, within the time named in this order. Upon the-record being taken into the Appellate Court for the Fourth District, on motion of the appellee, the bill of exceptions was-there stricken from the record, and the judgment of the circuit court affirmed.
