BACKGROUND

Plaintiff Kelly R. Bailey claims he suffered cumulative trauma to the spine due to the negligence of his employer, Defendant Union Pacific Railroad Company, while employed as a trainman for the railroad since February 1978. Complaint, ¶¶ 7-10, 12, 15. Plaintiff avers a second negligence claim against Union Pacific based on an incident occurring on July 14, 2003.
