Joseph C. Garcia was convicted of capital murder and sentenced to death in a Texas state court for the December 2000 killing of Irving, Texas, police officer Aubrey Hawkins. The Texas Court of Criminal Appeals (TCCA) summarized the facts of the crime as follows:

On December 13, 2000, seven inmates, including [Garcia], escaped from the Texas Department of Criminal Justice Connally Unit, taking with them a number of firearms stolen from the unit. On December 24th, the group committed a robbery at a sporting-goods store in Irv ing, killing Irving police officer…
