*304FAULKNER, Justice.
This is the second appeal of this case to this court. The first appeal is reported in City of Mobile v. Havard, 289 Ala. 532, 268 So.2d 805 (1972). The judgment of the trial court against Palmer & Baker was reversed and remanded by this court because the court held that plaintiff had failed to allege a duty owed to plaintiff’s decedent by Palmer & Baker, the breach of which was the proximate cause of the decedent’s injury, and therefore, the affirmative charge should have been given by the trial judge.
