Appeal from a judgment of the superior court for Spokane county, Blake, J., entered June 2, 1913, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries sustained in a collision with a street car.

This is an action for damages for personal injuries, sustained by the plaintiff in a collision of one of the defendant’s street cars with the plaintiff’s wagon, on Sprague Avenue, between Altamont and Cook Streets, in the city of Spokane. This appeal is from a judgment rendered upon the verdict of a jury in a second trial of the action. On the *83first trial, the court, at the close of the evidence, instructed the jury to find a verdict for the defendant.
