Appeal from a judgment of the superior court for Spokane county, Mitchell, J., entered May 27, 1915, upon granting a nonsuit, dismissing an action for wrongful death.

Fred S. Scharf was killed by being run over by one of the defendant railway’s electric motor engines in its switching yards at Spokane. His widow brings this action to recover, on behalf of herself and his minor heirs, for his death.

The facts as disclosed by the evidence are, in substance, these: Front avenue, one of the streets of the city of Spokane which parallel the switch yard of defendant, was almost impassable for some length of time, and people, under the necessity of passing to and from their homes in that section of the city, had been making use of the switch yard for a…
