MEMORANDUM OPINION
This case is before me on plaintiffs and cross-defendant’s motions for summary judg ment. 1 The parties have briefed the issues contained in these motions and the Court has heard oral argument. The motions are, therefore, ripe for disposition. 2 For the reasons stated below, I will grant both motions on the ground that the government may not continue to levy upon a deed of trust note owned by the plaintiff.
