Plaintiff Ari & Co., Inc. (“Ari”) commenced this action against defendant Regent International Corporation (“Regent”) alleging breach of a marketing and sales agreement (the “Agreement”) between the parties. Ari asserts three claims for relief against Regent. Two of the claims are based on breach of contract and allege termination of the Agreement without cause and failure to pay an incentive commission and commissions due to sales made prior to the termination of the Agreement.
