The Court instructs the jury that if they find from the evidence that prior to and on the 28th day of December, 1902, the plaintiff, Mollie E. On Sunday, December 28th, 1902, Dr. Harry N. Rickards, acting as agent for his wife, Mollie E. Rickards, the appellee, traded a certain horse belonging to or alleged to be owned by the appellee, to the appellant, J. Nelson Rickards, and forthwith delivered the horse to the appellant. Two days afterward the appellee sued out a writ of replevin to recover the horse. The record was removed on the suggestion and affi davit of the appellee from the Circuit Court for Caroline County to the Circuit Court for Kent County, where the case was finally tried.
