MEMORANDUM OPINION

Before the Court are the motions of the defendants, Davidson Alfred and Lamorthe Delva, for judgments of acquittal or, in the alternative, for a new trial.

I. FACTUAL AND PROCEDURAL HISTORY

On December 6, 2012, the grand jury returned a three-count indictment (the “Indictment”) against Davidson Alfred (“Alfred”) and Lamorthe Delva (“Delva”).
