This matter is before the Court on the Motion for Partial Summary Judgment [Docket No. 17] filed by plaintiff Ward-craft Homes, Inc. (“Wardcraft”) and the Motion for Summary Judgment [Docket No. 24] filed by defendant Employers Mutual Casualty Company (“EMC”). This Court has subject matter jurisdiction pursuant to 28 U.S.C. § 1332.
