Defendant Frannzo Smith • is charged with one count of conspiracy to distribute and possess with intent to- distribute 280 grams or more of cocaine base in violation of- 21 U.S.C. § 846, and one count of unlawful use of a communications facility to facilitate the commission of a drug felony in violation of 21 U.S.C. § 843(b).
