Plaintiff moves for an order to vacate a decision which directed a verdict for the defendants, and to order a new trial.

This is an action to recover $1,000 death benefits on two certificates of life insurance, each in the amount of $500, issued by the defendant, Hudson & Manhattan Railroad Company, to the plaintiff’s (now deceased) husband, John Ponce De Leon (also known as Raymond Ponce De Leon), an employee of the railroad company (hereinafter called the Assured).
